Using reputational damaging language regarding AudaCity Capital, whether internal or external, without a valid basis is strictly prohibited. This includes but is not limited to posting negative reviews or comments online. By participating in our programs, you understand that AudaCity Capital values its reputation and will take necessary action to protect it. You further acknowledge that any violations of this provision may result in termination of your participation in the programs and may be subject to legal action.

*Consistency Clause

‍Traders will need to demonstrate consistency within their results in regards, but not limited to trade length and lot size in order to pass the  minimum trading days required for the specific programs. For example if a trader opens one position at 15 lots on one day, then 6 positions at 0.1 lot on 6 other trading days, this will result in failing the Ability Challenge. Additionally, the risk team reserves the right to assess consistency based on the trader’s style, including but not limited to lot size and trade duration.

2. Demo Challenge

2.1 The Services consist of the provision of tools for simulated trading on financial markets. Financial market information is used in the simulated trading; however, you acknowledge that any trading that you perform through the Services is not real. You also acknowledge that the funds provided to you for demo trading are fictitious and that you have no right to possess those fictitious funds beyond the scope of their use within the Services, and in particular that they may not be used for any actual trading and that you are not entitled to the payment of those funds. Unless expressly agreed otherwise, you will not be paid any remuneration or profits based on the results of your simulated trading, nor will you be required to pay any losses.

2.2 Failure to engage in trading activity on your funded account for a consecutive one-month period will lead to the termination of your account due to inactivity.

3. Fees

3.1 The fee for the Ability Challenge varies according to the option selected and depends on the amount of the initial capital. More detailed information on individual options and fees for those options are provided on the website. The final fee will be determined based on the option you select when completing the form for ordering the Ability Challenge. The Provider reserves the right to also provide the Services under individually agreed conditions. All individually agreed conditions shall be determined by the Provider at its own discretion. ALL PAYMENTS ARE FINAL AND FOR EVALUATION PURPOSES ONLY.

3.2 The registration fees are paid for allowing you to access the Ability program platform, models and services. The Customer is not entitled to a refund of the registration fees if the service has been started (i.e. the account has been purchased) and/or the customer did not successfully complete the Evaluation. The customer is not entitled to open a dispute for the paid fee with the Customer’s bank or payment service provider as the completion of the purchase entitles the acceptance of the T&C.

3.3 The amounts of fees for the Ability Challenge options are in Great British Pounds. In the event of payment of the fee in any other currency than the GBP, the amount of the fee for the selected option shall be converted using the most recent exchange rate.

3.4 You can pay the fee for the selected option of the Ability Challenge by a payment card, via a bank transfer, or using other means of payment that the Provider currently offers on the Website.

Irresponsible Trading

The risk management team will reserve the right to terminate the agreement and to revoke access to the account in case of trading misconduct, that will include, but is not limited to, any sort of illegal activity, arbitrage and gambling behaviour on the live environment.

AudaCity Capital reserves the absolute right to withdraw any trader from the programs, at any time and without giving any explanation. Engaging in conduct that is deemed by AudaCity Capital to be misconduct or negligence, including but not limited to gambling our capital or taking excessive risks, may result in immediate withdrawal from the program. By participating in our programs, you acknowledge and agree to this provision, and understand that AudaCity Capital will not be liable for any losses or damages resulting from such withdrawal. 9.2 If AudaCity Capital decides to withdrawal a trader from the program, the joining fee will be not refunded.

2. Funded trader account

2.1 The Services consist of the provision of tools for trading in live environment on financial markets.  AudaCity Capital shall supply risk monitoring services, and a trading account in live environment using MT4/MT5. AudaCity operates within the financial services community and trades only own funds, but AudaCity itself does not carry out any regulated activities and consequently is not required to be authorized by the Financial Conduct Authority. All of AudaCity’s preferred clearers do conduct regulated activities and are authorized to do so by the Financial Conduct Authority.

2.2 Failure to engage in trading activity on your funded account for a consecutive one-month period will lead to the termination of your account due to inactivity.

2.3 NONE OF THE SERVICES PROVIDED TO YOU BY THE PROVIDER CAN BE CONSIDERED INVESTMENT SERVICES IN ACCORDANCE WITH APPLICABLE LAWS. THE PROVIDER DOES NOT GIVE OR PROVIDE TO YOU ANY GUIDANCE, INSTRUCTIONS, OR INFORMATION ABOUT HOW OR IN WHICH MANNER YOU SHOULD PERFORM TRANSACTIONS WHEN USING THE SERVICES OR OTHERWISE, OR ANY OTHER SIMILAR INFORMATION ABOUT THE INVESTMENT TOOLS TRADED, NOR DOES THE PROVIDER ACCEPT ANY SUCH GUIDANCE, INSTRUCTIONS, OR INFORMATION FROM YOU. NONE OF THE SERVICES CONSTITUTE INVESTMENT ADVICE OR RECOMMENDATIONS. NO EMPLOYEES, STAFF, OR REPRESENTATIVES OF THE PROVIDER ARE AUTHORIZED TO PROVIDE INVESTMENT ADVICE OR RECOMMENDATIONS. 2.4 Ownership and Discretion over Orders: Any order initiated by a trader is the exclusive property of Audacity. The firm retains complete discretion to manage such orders internally or to execute them, based on the company’s overall risk profile and the individual performance of the trader. Under no circumstances is Audacity obligated to fulfil or honour any order. The firm reserves the right to reject, hold, or execute any order at its sole discretion. It is to be expressly understood that our traders operate as contractor team members under a self-employed contract and are not considered clients of Audacity.

3. Fees

3.1 The fee for the Funded Trader Program varies according to the option selected and depends on the amount of the initial capital. More detailed information on individual options and fees for those options are provided on the website.. The Provider reserves the right to also provide the Services under individually agreed conditions. All individually agreed conditions shall be determined by the Provider at its own discretion.

3.2 No-Chargeback Clause: By entering into this agreement, you acknowledge and agree that you will not file a chargeback with your bank or credit card issuer for any transaction made under this agreement if the service has been started.

3.3 Refund: The registration and facilitation fees are paid for allowing the customer to access the Funded Trader program platform, models and services. The Trader is not entitled to a refund of the registration fees and/or facilitation fees if the service has been started (i.e. the account has been purchased), the fees are non-refundable once the trader has started their trading activity on the account. This includes both full and partial refunds. ALL PAYMENTS ARE FINAL.

3.4 The customer is not entitled to open a dispute for the paid fee with the Customer’s bank or payment service provider as the completion of the purchase entitles the acceptance of the T&C.

3.5 The amounts of fees for the Ability Challenge options are in Great British Pounds. In the event of payment of the fee in any other currency than the GBP, the amount of the fee for the selected option shall be converted using the most recent exchange rate.

3.6 You can pay the fee for the selected option of the Funded Trader Program by a payment card, via a bank transfer, or using other means of payment that the Provider currently offers on the Website.

4. Employment Status

4.1 For the purposes of this Contract, the Trader shall be an independent self-employed contractor trading as a separate legal entity in his own right, and not the servant, employee, partner, representative or agent of AudaCity Capital and he has no power or authority to enter into any contract on behalf of AudaCity Capital or the Trading Company.

4.2 The Trader shall bear exclusive responsibility for the payment of his National Insurance contributions as a self employed person and for discharge of any Income Tax, VAT and any other taxation liability arising out of remuneration or trading profits earned under this Contract.

4.3 The Trader agrees to indemnify and keep indemnified AudaCity Capital against all liability arising out of any amount of Income Tax, VAT or any other taxation liability or National Insurance contributions to which AudaCity Capital may be assessed in respect of the Trader’s performance (such indemnity to include any legal and accounting costs on an indemnity basis which AudaCity Capital incurs).

4.4 The Trader if approved to the program will be considered and treated as professional trader not retail trader, assuming you’re having a high level of knowledge, expertise and experience, understanding of risk involved in the financial market.

4.5 The Trader operates as a contractor for Audacity Capital, utilizing our infrastructure for trading purposes. They are not regarded as clients since Audacity Capital does not maintain any client relationships.

5. Risk Management Rules

Please be advised that we require you to utilize your own Trading System in combination With Audacity Capital’s money management trading rules as stated below:

-You start with a book of your preferred size as chosen from the available sizes on the website and we double for you the size of the account and volume allowed every 10% target.

-Overnight and over the weekend positions are allowed.

-The trader is NOT allowed to trade major events including: NFP, interest rates decisions, Central banks speeches etc., all exposure must be cleared 30 minutes before the events.

– If an absolute drawdown of 10% occurs in the account we have the right to terminate the agreement, disable the trading account  and the trader is not liable to losses.

– If a daily drawdown of 5%, trailing from the equity, occurs in the account we have the right to terminate the agreement, disable the trading account  and the trader is not liable to losses.

-The trader is allowed to trade majors and minor cross pairs, but is not allowed to trade any exotic, the trader can trade on gold in the form of XAUUSD, indices as NAS100, DOW30, SP500, GER30.

6. Profit Sharing

6.1 The Trader receives a predetermined percentage of all profits that will depend on the stage of the account, the initial capital purchased and the time taken to reach the target.

6.2 The Trader is compensated on a profit split basis only, and receives the share of the profits once (and only when) the Trader hits the target of ten percent.

6.3 Audacity Capital doubles the size of the account every time the Trader reaches a target of 10% profit within the risk parameters, up to a maximum predetermined by Audacity Capital. Any profit or loss made without respecting risk rules Audacity is not entitled to a payout and may cause the termination of the agreement and the termination of the participation in the programs.

6.4 Any activities related to arbitrage (including latency, one leg, two legs, pairs, or any other type of arbitrage) or any illegal, malicious, manipulative, or toxic trading activities, is not entitled to payout. By participating in our programs, you accept that any violations of our risk rules and parameters or engagement in any of the aforementioned activities may result in forfeiture of profits and termination of your participation in the programs. You also agree to indemnify and hold harmless AudaCity Capital from any losses or damages resulting from your engagement in such activities.

Irresponsible Trading

The risk management team will reserve the right to terminate the agreement and to revoke access to the account in case of trading misconduct, that will include, but is not limited to, any sort of illegal activity, arbitrage and gambling behaviour on the live environment.

AudaCity Capital reserves the absolute right to withdraw any trader from the programs, at any time and without giving any explanation. Engaging in conduct that is deemed by AudaCity Capital to be misconduct or negligence, including but not limited to gambling our capital or taking excessive risks, may result in immediate withdrawal from the program. By participating in our programs, you acknowledge and agree to this provision, and understand that AudaCity Capital will not be liable for any losses or damages resulting from such withdrawal. 9.2 If AudaCity Capital decides to withdrawal a trader from the program, the joining fee will be not refunded.
